These Terms form a legally binding agreement between you and Joyolabs Inc. By using our Service, you acknowledge that you have read, understood, and agree to comply with these Terms and any additional guidelines we may publish.

We may modify or update these Terms at any time at our sole discretion. Material changes will be communicated via updates within the app or on this page. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

2. Use of Our Service

2.1 Permitted Use and Content Submission

When using Craftnote, you agree to:

• Use the Service only for personal, educational, or informational purposes.
• Submit only audio recordings, files, text, YouTube links, and content that you have the legal right to share.
• Maintain confidentiality of your account credentials.
• Understand that speech-to-text and summarization results are based on algorithms and may require verification.
• Acknowledge that Craftnote's generated content is informational and not professional advice.

2.2 Prohibited Actions

You agree not to:

• Upload or submit content that infringes on any third-party's rights.
• Upload malware, viruses, or harmful code.
• Attempt to reverse engineer, copy, or extract algorithms used in Craftnote.
• Use automated means (bots, scripts) to access or collect data from the Service.
• Share or resell your access to others.
• Use the Service for unlawful, harmful, or misleading purposes.

3. Content and Data

3.1 Your Content

"Your Content" includes audio recordings, files, text, YouTube links, and any other materials you upload to Craftnote. By submitting content, you:

• Retain full ownership of your original content.
• Grant us a limited license to process, store, and analyze your content solely for providing the Service.
• Confirm you have all rights and permissions to share such content.
• Understand that your content is retained as long as your account is active and can be deleted upon request.

3.2 Generated Content

"Generated Content" includes summaries, flashcards, quizzes, transcriptions, and other materials created by Craftnote. You acknowledge that:

• Generated Content is for informational and educational purposes only.
• It should not be treated as professional or expert advice.
• Accuracy may vary based on input quality (e.g., audio clarity, content complexity).
• You may use Generated Content for personal and non-commercial purposes only.

4. Service Limitations

4.1 Technical Limitations

• File size, format, or length restrictions may apply.
• Processing time varies with content complexity and network speed.
• YouTube processing depends on video availability and accessibility.
• Speech-to-text accuracy varies with audio quality.
• Service may be periodically unavailable for maintenance or updates.

4.2 Usage Limits

We may impose reasonable limits on:

• Number of files processed per day
• Total storage space per account
• Length of audio/video content
• API call frequencies

5. Subscriptions & In-App Purchases

5.1 Subscription Model

Craftnote offers optional premium features through in-app purchases or recurring subscriptions ("Subscriptions"). These may include expanded processing limits, advanced features, or enhanced storage options.

5.2 Billing and Renewal

• Payment for Subscriptions is processed securely through the Apple App Store or Google Play Store, depending on your platform.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period.
• You can manage or cancel your Subscription in your device's account settings.

5.3 Refunds

Refunds are handled directly by the platform provider (Apple or Google) according to their policies. Please refer to Section 11 (Refund Policy) for detailed information about our refund terms.

5.4 Third-Party Payment and Subscription Tools

Craftnote uses trusted third-party partners to manage subscriptions, paywalls, and analytics, such as Adapty and Superwall. By purchasing or managing Subscriptions through these tools, you also agree to their respective privacy and terms policies.

6. Intellectual Property

6.1 Our Rights

The Service, including software, algorithms, design elements, and user interface, is the exclusive property of Joyolabs Inc and its licensors. You agree not to reproduce, distribute, or create derivative works based on our intellectual property without written consent.

6.2 Trademarks

"Craftnote" and all related logos and branding are trademarks or registered trademarks of Joyolabs Inc.

7. Privacy and Data Protection

Our handling of personal data is governed by our Privacy Policy. Key points include:

• Your data is processed solely for providing and improving the Service.
• Audio recordings and content are encrypted and stored securely.
• You may request deletion of your account and associated data.
• We never sell your personal data to third parties.

8. Disclaimers of Warranties

The Service is provided "as is" and "as available." We do not warrant that:

• The speech-to-text conversion or summaries will be accurate, complete, or suitable for professional purposes.
• The Service will be uninterrupted, error-free, or secure at all times.
• Results will meet your specific expectations.

Use of Craftnote is at your own discretion and risk. Always verify important information through original sources.

9. Limitation of Liability

To the fullest extent permitted by law, Joyolabs Inc is not liable for:

• Inaccuracies or misinterpretations in generated summaries or transcriptions.
• Any loss or deletion of your content.
• Service interruptions or access delays.
• Indirect, consequential, or punitive damages.

In no event shall our total liability exceed the amount you paid (if any) for using the Service in the 12 months preceding the claim.

10. Termination

10.1 By Joyolabs

We may suspend or terminate access to your account if you:

• Violate these Terms.
• Engage in fraudulent or harmful activity.
• Remain inactive for extended periods.
• If the Service is discontinued.

10.2 Effect of Termination

• Your right to use the Service ceases immediately.
• We may delete your stored data after reasonable notice.
• You may request export or deletion of your data before termination takes effect.

11. Refund Policy

All purchases and subscriptions for Craftnote made through the Apple App Store are processed and managed entirely by Apple. Apple retains sole and absolute discretion over all refund decisions, and Joyolabs Inc has no ability to grant, deny, influence, or otherwise impact any refund request. You acknowledge and agree that any refund request must be submitted directly to Apple, and that Apple's decision on such request is final.

To the extent permitted by applicable law, all purchases are non-refundable and non-exchangeable, unless otherwise required by applicable law or approved by Apple at its sole discretion.

11.1 How to Request a Refund

Since all payment processing and refund decisions are handled exclusively by Apple, you must contact Apple directly to request a refund. You can do so through Apple's "Report a Problem" page or by contacting Apple Support. Joyolabs Inc cannot process, approve, or deny refunds on Apple's behalf.

11.2 Service Consumption

Please be aware that each interaction with Craftnote generates server and AI model costs. Once the service has been substantially used, Apple may take this into consideration when evaluating refund requests under its own policies. However, the final determination rests entirely with Apple.

11.3 Country-Specific Rules

(a) European Union / Switzerland / UK / Turkey

If you are a consumer located in the EU, EEA, UK, Turkey or Switzerland, you may have a legal right of withdrawal under local consumer protection laws. BY COMPLETING YOUR PURCHASE, YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE DIGITAL SERVICE AND CONFIRM THAT YOU WAIVE YOUR RIGHT OF WITHDRAWAL ONCE THE CONTENT IS MADE AVAILABLE. Notwithstanding the foregoing, any refund request must be directed to Apple, which retains sole discretion over the approval or denial of such request.

(b) United States

All refund requests for purchases made through the Apple App Store must be submitted directly to Apple. Apple will evaluate and decide on refund requests in accordance with its own refund policies. Joyolabs Inc has no control over and cannot influence Apple's refund decisions.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Disputes shall be resolved through:

• Good-faith negotiations; and
• If unresolved, binding arbitration or competent courts in the State of Delaware, United States.
